Welcome to Break X Golf (“BxG”), operated by Practice Labs LTD (“we,” “us,” or “our”). By using our website, web app, or mobile applications, you agree to the following terms and conditions. Please read them carefully.
1. Acceptance of Terms
By accessing or using BxG, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must discontinue use immediately.
2. User Obligations & Prohibited Activities
When using BxG, you agree to:
- Use our services only for lawful purposes.
- Not engage in data scraping, account sharing, or unauthorised commercial use.
- Not misuse our games, proprietary data, or practice tools for redistribution or resale.
- Not attempt to reverse engineer, modify, or exploit any part of the BxG platform.
- Share screens, games, and achievements only within permitted social media settings.
Violating these terms may result in suspension or termination of your account.
3. Subscription & Refund Policy
- BxG operates on a subscription-based model ($19.99/month or $179/year).
- All payments are processed securely via Stripe.
- Users may request a full refund within 30 days of their initial purchase by emailing admin@breakxgolf.com.
- After 30 days, all payments are non-refundable except where required by applicable law.
- Subscriptions automatically renew unless cancelled before the renewal date. You can cancel at any time from within your account settings.
iOS App Users
If you access Break X Golf through the iOS App Store, your use of the app is also subject to Apple’s Standard End User Licence Agreement (EULA), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
In the event of any conflict between these Terms of Service and Apple’s EULA, Apple’s EULA shall take precedence in relation to your use of the iOS app.
4. Physical Activity, Drills & Injury Disclaimer
Break X Golf provides golf practice content including dynamic stretching warm-ups, skill drills, on-course challenges, and distance-focused practice exercises. This content is delivered via a mix of video demonstrations and written or visual instructions.
By using any practice content within BxG, you acknowledge and agree that:
- All drills, warm-ups, and practice exercises are provided for informational and educational purposes only.
- Golf practice — including driving distance drills and dynamic warm-ups — carries an inherent risk of physical injury.
- You are solely responsible for assessing your own physical fitness and suitability before attempting any drill or exercise.
- Practice Labs LTD accepts no liability for any injury, loss, or damage sustained while following any practice content provided by BxG.
- If you have any pre-existing physical condition, injury, or health concern, you should consult a qualified medical professional before undertaking any physical activity suggested by the app.
- The app suggests a practice frequency of up to five sessions per week. It is your responsibility to determine when and how long to practise. BxG does not require or instruct you to complete sessions at any specific time or intensity.
5. Practice Guidance & Coaching Disclaimer
BxG provides data-driven, algorithm-generated practice recommendations based on your self-reported golf statistics. These recommendations are personalised in the sense that they reflect your data, but they are not a substitute for professional golf coaching.
By using BxG, you acknowledge that:
- BxG is a practice planning and tracking tool, not a coaching service.
- Recommendations relating to shot shape, start direction, technique focus areas, and practice priorities are generated algorithmically and are not provided by a qualified golf professional.
- We actively encourage users to work alongside a PGA-qualified golf coach to develop their technique. BxG is designed to complement — not replace — professional coaching.
- Practice Labs LTD accepts no responsibility for any deterioration in performance, technique, or playing ability arising from the use of BxG practice content.
6. Account Suspension & Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms of Service.
- Engage in fraudulent activities.
- Use BxG’s proprietary data or games for personal commercial gain without permission.
- Exhibit abusive, disruptive, or harmful behaviour towards our staff or other users.
Where possible, we will give notice before suspension. In cases of serious breach, we reserve the right to terminate immediately without notice.
7. Intellectual Property Rights
- All content, including practice plans, skills games, analytics, aggregated data, and proprietary performance analysis, remains the property of Practice Labs LTD.
- Users may not reproduce, repurpose, or sell any BxG intellectual property without written consent.
- BxG reserves the right to use anonymised, aggregated data for research, product development, and benchmarking purposes, as set out in our Privacy Policy.
8. Data Usage & Anonymised Benchmarks
- We use anonymised user data to create trends, benchmarks, and performance analytics.
- Aggregated data helps us analyse practice patterns by handicap level and identify trends in golfer improvement.
- By using BxG, you consent to the anonymised use of your playing stats for research, analysis, and feature development.
- No personally identifiable information is included in any benchmarking or published analysis.
9. Limitation of Liability
To the fullest extent permitted by applicable law:
- Practice Labs LTD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of BxG.
- Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
- Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
10. Dispute Resolution & Governing Law
- These Terms are governed by the laws of England and Wales.
- Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
- If you are resident in the European Union or another jurisdiction, you may also have rights under your local consumer protection laws that cannot be excluded by contract. Nothing in these Terms affects those statutory rights.
11. Age Restrictions
- Users must be 13 or over to register an account.
- BxG is not directed at children under 13. If we become aware that a user is under 13, we will close their account and delete their data.
12. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Where changes are material, we will notify you by email or in-app notification. Continued use after the effective date of any update constitutes acceptance of the revised Terms.
